These Terms of Service ("Terms") govern your use of Imagepedia ("Service," "we," "us"). By creating an account, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you confirm you have permission from a parent or guardian to use the Service.
2. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately at support@imagepedia.com if you suspect unauthorized access.
3. Important: identification is not professional advice
Species identifications provided by Imagepedia are automated, may be inaccurate, and are provided for informational and entertainment purposes only. Do not rely on Imagepedia to determine whether a plant, fungus, or animal is safe to touch, eat, or handle. Misidentifying wild plants or fungi can cause serious injury or death. Always consult a qualified expert and independent, reliable sources before consuming, touching, or otherwise interacting with anything you find in the wild. We are not liable for any harm resulting from reliance on an identification made through the Service.
4. Your content
You retain ownership of the photos you upload. By submitting a photo, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display it as part of operating the Service (for example, showing it in your discovery history and achievements). You're responsible for making sure you have the right to share any photo you upload, and that it doesn't violate anyone else's rights or the law.
5. Acceptable use
You agree not to:
- Upload content that is illegal, infringing, or violates another person's privacy or rights;
- Use the Service to harass, harm, or impersonate others;
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or other users' accounts;
- Use automated means to scrape or bulk-collect data from the Service without our written permission.
6. Public information
Your display name and achievement count are visible to other users on the leaderboard. Don't use a display name that impersonates someone else or reveals personal information you don't want public.
7. Termination
You can stop using the Service and request account deletion at any time (see our Privacy Policy). We may suspend or terminate accounts that violate these Terms.
8. Disclaimers
The Service is provided "as is," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted, error-free, or that identifications will be accurate.
9. Limitation of liability
To the fullest extent permitted by law, Imagepedia will not be liable for any indirect, incidental, special, or consequential damages, or for any harm resulting from reliance on species identifications, arising from your use of the Service.
10. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes we'll make reasonable efforts to notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
11. Governing law
[To be finalized once the operating entity and jurisdiction are established.] These Terms will be governed by the laws of the jurisdiction in which Imagepedia's operating entity is organized, without regard to conflict-of-law principles.
